Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BrainRush mobile application and related services ("Service"). By accessing or using BrainRush, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

BrainRush is a multiplayer trivia game that allows users to create game rooms, invite friends, compete in real-time quiz rounds, track scores on leaderboards, and build XP-based profiles. The Service includes the mobile application, backend game servers, and any related websites or APIs.

2. Eligibility

You must be at least 13 years old to use BrainRush. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts & Authentication

3.1 Registration

To use most features, you must create an account. You can register using:

  • Email and password (managed via Supabase Auth)
  • Google OAuth sign-in

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Information

You agree to provide accurate and complete information when creating your account, including your username. You may not impersonate others or use offensive, misleading, or trademarked usernames without authorization. We reserve the right to suspend or terminate accounts that violate this policy.

3.3 Termination

You may delete your account at any time through the in-app settings. We may suspend or terminate your account if you violate these Terms, engage in cheating, harassment, or any behavior that disrupts the Service. Upon termination, your access to the Service will cease, but certain data (such as match records involving other players) may be retained as required for the integrity of the Service.

4. User Conduct

By using BrainRush, you agree not to:

  • Cheat, exploit bugs, or use unauthorized third-party tools to gain an unfair advantage
  • Harass, abuse, threaten, or intimidate other users
  • Share content that is illegal, obscene, defamatory, hateful, or infringing on others' rights
  • Spam other users with unsolicited invites, messages, or friend requests
  • Attempt to reverse-engineer, decompile, or interfere with the app's code or servers
  • Create multiple accounts to manipulate rankings, XP, or leaderboard positions
  • Use automated scripts, bots, or scrapers to access the Service
  • Impersonate BrainRush staff, moderators, or other users

Violation of these rules may result in temporary or permanent suspension of your account, forfeiture of XP or rankings, and deletion of offending content.

5. Game Rooms & Multiplayer

5.1 Room Creation

Users can create private game rooms and share room codes to invite others. Room codes are intended for private use. Do not share room codes publicly or use them to harass users who do not wish to participate.

5.2 Fair Play

All players in a room are expected to compete fairly. Using external resources (search engines, AI assistants, etc.) during active trivia rounds is considered cheating unless the game mode explicitly allows it. We reserve the right to disqualify scores suspected of cheating.

5.3 Content in Rooms

While BrainRush does not currently support in-room chat, any usernames or avatars visible to other players must comply with the conduct rules above. We may moderate or filter offensive content.

6. Intellectual Property

6.1 Our Content

BrainRush, including its code, design, graphics, logos, trivia content, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without express written permission.

6.2 Your Content

You retain ownership of your username and any custom avatar images you upload. By using the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of operating and improving the Service (e.g., showing your avatar and username to other players in game rooms and leaderboards).

6.3 Feedback

We welcome feedback and suggestions. By submitting feedback, you grant us the right to use it without restriction or compensation.

7. Advertising

BrainRush is free to use and supported by advertising through Google AdMob. You acknowledge that:

  • Advertisements may be displayed during gameplay
  • We do not control the content of third-party ads
  • Your interactions with ads are governed by the advertiser's policies
  • We may offer ad-supported and ad-free tiers in the future

8. In-App Purchases & Virtual Goods

Currently, BrainRush does not offer in-app purchases or virtual currency. If this changes in the future, additional terms will apply and will be presented at the time of purchase. All virtual goods remain the property of BrainRush and are licensed to you for use within the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • THAT ANY DEFECTS WILL BE CORRECTED
  • THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

We do not guarantee the accuracy, completeness, or timeliness of trivia questions or answers. Trivia content is generated via automated systems and may occasionally contain errors.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAINRUSH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless BrainRush and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BrainRush operates, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

13. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you via the app or by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
